Terms of Use

Hereiam is operated by Hereiam, with a place of business at Humayunpur, New Delhi, Delhi 110029, India (“Hereiam”, “we”). These terms apply to the Hereiam website, the installable web app, and every feature in them, including shop discovery, menu ordering, digital stamp cards and rewards.

Where these terms refer to a “shop”, we mean an independent business listed on Hereiam. Shops are not our agents, employees or franchisees.

You sign in with a mobile number and a one-time password, or with your Google account. You must give a number you control, be at least 18 years old, and keep your information accurate.

• One account per person. Stamps are not transferable between accounts.
• Keep your one-time password to yourself. Anyone who can read it can enter your account.
• You are responsible for activity taken through your account, except where it results from our failure.
• Tell us at once if you suspect unauthorised use, and we will end the sessions concerned.

We provide the software: discovery, the order queue, and the stamp card. The goods and services you buy are supplied by the shop, and the contract of sale is between you and the shop. The shop is responsible for the quality, quantity, safety, hygiene, pricing and fulfilment of what you order, and for honouring the rewards it offers. We do not prepare, pack, deliver or sell food or drink, and we do not process payments.

Shop listings, prices, hours, availability and reward descriptions are supplied by the shop. We take care in presenting them but cannot guarantee that every detail is current.

A stamp is a record of a qualifying purchase, issued by the shop’s staff at the counter and credited to your card for that shop. Stamps have no cash value and cannot be sold, exchanged or transferred.

• The shop decides what counts as a qualifying purchase, how many stamps a purchase earns and the number of stamps needed for a reward. The current rule is shown on the card.
• When the card is full, one reward is unlocked. Rewards are redeemed at the shop, within its opening hours, and are limited to the reward described on the card.
• Stamps remain on your card while your account is active. If your account is deleted, the stamps and any unlocked reward are lost.
• A shop may change or end its loyalty programme. A programme that has ended does not affect a reward you had already unlocked, which the shop will honour within a reasonable time.
• We may reverse stamps and cancel rewards that were credited in error, duplicated, obtained without a qualifying purchase, or obtained by any misuse of the system.
• Stamps stay visible in your wallet even if a shop later stops showing its card publicly, so you can redeem what you have earned.

An order placed through Hereiam is a request to the shop, sent to its counter. It is not a payment and does not guarantee that an item is in stock. Payment is made directly to the shop at the counter, at the price shown. A shop may decline or cancel an order — for example if an item has run out or if it is closing — and will tell you at the counter.

Nothing in these terms affects your rights against the shop under the Consumer Protection Act, 2019.

You agree not to:

• collect stamps you have not earned, re-use a card code, or present another person’s card;
• copy, scrape, reverse engineer or interfere with the app, its servers or its security;
• use another person’s account, or impersonate anyone;
• post content that is unlawful, abusive, defamatory, obscene, misleading or infringes someone’s rights;
• post reviews that are not your own honest experience of the shop; or
• use the service to break any law.

We may remove content, reverse stamps, or suspend or close an account that breaches these terms. Where the matter is minor, we will try to warn you first.

You keep ownership of the notes and reviews you write. You give us a non-exclusive, royalty-free licence to store, display and share them within Hereiam, for as long as they remain on the service. We may moderate, shorten or remove content that breaches clause 6, and we may show a reason for removal to the shop concerned. Do not post personal information about other people.

Nearby alerts work only if you allow location and notifications in your browser, and only while the app is open. They rely on your device comparing its position with the coordinates of shops you already hold stamps at; your position is never sent to us. We do not guarantee that an alert will arrive, and you should not rely on one. You can switch alerts off at any time in your browser or phone settings.

Shops join by agreement with us, not by creating a customer account. If you own a shop:

• you confirm you are authorised to act for the business and that the details, menu, prices and reward you give us are accurate and current;
• you will honour stamps and unlocked rewards issued through Hereiam, and record them honestly;
• your listing is shown publicly only after we approve it; and
• the first month is free, and any fee after that is the one we agree with you in writing. We will give you at least 30 days’ notice of a fee change.

We may suspend or end a listing if a shop breaches these terms, misuses stamps, or if we end the service. On ending a listing, customers’ existing stamps remain visible to them for redemption for 90 days.

The Hereiam name, logo, design and software belong to us. You may not use them without our written permission. Shop names, logos and photographs belong to the shops and are used with their permission.

The service is provided as it is. We may add, change or withdraw features, and we may pause the service for maintenance or because of a technical problem. We do not promise uninterrupted availability, and we do not charge you for using the app. If we discontinue the service, we will give reasonable notice so that unlocked rewards can be redeemed.

To the extent permitted by law, we are not liable for the acts and omissions of a shop, including the quality or safety of food and drink, delay, refusal of service, or a shop’s failure to honour a reward. We are not liable for indirect or consequential loss, or for loss of profit, goodwill or data.

Where liability nevertheless arises, our total liability to you for all claims in any six-month period is limited to the greater of ₹1,000 or the amount you have paid us in that period. Nothing in these terms limits liability that cannot be limited by law, including your rights under the Consumer Protection Act, 2019.

You may stop using Hereiam at any time, and may ask us to delete your account as described in the Privacy Notice. We may suspend or close your account if you materially breach these terms, if we are required to by law, or if we discontinue the service. Clauses 7, 10, 12 and 14 survive the end of this agreement.

These terms are governed by the laws of India. The courts at Delhi have exclusive jurisdiction, subject to any right you have to approach a consumer forum or commission. Before starting a formal claim, please write to us — most issues are settled in a conversation.
